All users of this website agree that access to and use of this website are subject to the terms and conditions set forth below and all applicable law. These Terms & Conditions constitute a legally binding agreement between you, whether personally or on behalf of an entity (“you”), and the Rocky Mountain Bighorn Society, concerning your access to and use of bighornsheep.org and any related media channels, mobile sites, or applications (collectively, the “Site”). By using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you do not agree to these Terms & Conditions, you are prohibited from using the Site.

UPDATES

The Rocky Mountain Bighorn Society (“RMBS”) reserves the right, at its sole discretion, to modify or replace these Terms & Conditions at any time and for any reason. Updates will be indicated by a revised “Last Updated” date. You waive any right to receive specific notice of each change. Your continued use of the Site after updated Terms & Conditions are posted constitutes your acceptance of those changes.

RMBS does not guarantee that the Site will always be available or error-free. Maintenance, hardware or software issues, or other problems may result in interruptions or delays.

CORRECTIONS

The Site may contain typographical errors, inaccuracies, or omissions, including descriptions, availability, pricing, or other information. RMBS reserves the right to correct such errors or update information at any time without prior notice.

INTELLECTUAL PROPERTY

Unless otherwise stated, all content on the Site—including text, graphics, photographs, videos, design elements, databases, and source code—is the property of RMBS and/or its contributors and is protected under United States and international copyright laws (“Content”).

All trademarks, service marks, and trade names associated with RMBS used on the Site are the property of the Rocky Mountain Bighorn Society (“Marks”). All other trademarks appearing on the Site belong to their respective owners.

Unauthorized use of RMBS Content or Marks is prohibited and may violate state and federal law.

GUIDELINES FOR USE OR REPRODUCTION OF CONTENT

Permission to use, copy, or distribute materials from the Site is granted under the following conditions:

Content and Marks are provided as-is for informational and personal use only.
Written permission from RMBS is required before copying, reproducing, republishing, uploading, posting, transmitting, distributing, altering, or preparing derivative works of any Content.
RMBS-produced written content may be used for educational purposes, news reporting, scholarships, and informational nonprofit purposes, provided proper credit is given.

USER-GENERATED CONTENT

RMBS may allow users to submit content (“Contributions”), including photos, videos, comments, stories, or other materials.

By submitting Contributions, you grant RMBS an unrestricted, perpetual, worldwide, royalty-free license to use, copy, reproduce, publish, display, distribute, and create derivative works from your Contributions in any media now known or later developed.

You represent and warrant that:

You own the rights to your Contributions or have permission to submit them.
Your Contributions do not infringe any third-party rights.
Any identifiable individuals have given consent for their likeness to be used.
Your Contributions are not defamatory, obscene, harassing, unlawful, or otherwise objectionable.
Your Contributions are accurate and not misleading.
Your Contributions do not violate these Terms & Conditions or any applicable laws.

RMBS reserves the right (but is not obligated) to edit, remove, or reorganize Contributions for any reason.

You agree to hold RMBS harmless from any claims arising from your Contributions.

DISCLAIMER & LIMITATION OF LIABILITY

The Site is provided “as is.” RMBS makes no warranties regarding accuracy, completeness, or reliability of information on the Site.

RMBS, including its officers, directors, volunteers, employees, contractors, or representatives, shall not be liable for any damages of any kind arising from the use or inability to use the Site—including direct, indirect, incidental, punitive, or consequential damages, loss of data, revenue, or property.

RMBS is not responsible for any data loss submitted through the Site nor responsible for third-party links or content.

TERM AND TERMINATION

These Terms & Conditions remain in effect while you use the Site. RMBS reserves the right to deny access to the Site to any person for any reason, including violations of these Terms & Conditions. RMBS may terminate accounts, remove content, or restrict access without prior notice.

These Terms & Conditions and your use of the Site are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.

USER REGISTRATION & REPRESENTATIONS

If you create an account on the Site, you agree to:

Update your information as needed.
Not use the Site for unlawful or unauthorized purposes.
Be at least 13 years old or have verified parental permission.

RMBS may modify or remove any username deemed inappropriate.

THIRD-PARTY & USER CONTENT

Users retain copyright to their submissions but grant RMBS a perpetual license to use, display, and reproduce those submissions for any RMBS-related purpose.

PRIVACY POLICY

RMBS cares about data privacy and security. By using the Site, you agree to the RMBS Privacy Policy, which is incorporated into these Terms & Conditions. The Site is hosted in the United States.

RMBS does not knowingly collect information from children under 13 without verifiable parental consent.
